    Yes. Barking & Dagenham v SENDIST & MG [2007] EWHC 343: A FTT had been correct in its decision to proceed with an appeal hearing in the absence of the LA and had been correct to rule that staff shortages were not an excuse for failing to submit a statement of case within the requisite time limit.
