If a decision is made to electively home educate a child who previously had a school-based IDP, does the school-based IDP automatically cease upon deregistration from the school? Is the LA then required to determine whether it will maintain the IDP?

    Can't answer yes or no.:

    If the decision is taken to EHE then there is no longer an obligation on the school to maintain the IDP s. 31(1)(a) ALNET. The LA however then becomes responsible for assessing ALN and if there is ALN then it has to maintain a plan: s. 14. Responsibility for the IDP should under those circumstances simple transfer to the LA. ss. 36(7)&(8), however it would be advisable for parents to contact the LA informing them of the change and asking them to review and prepare maintain the IDP moving forward. 

    As to the duty on LA's see paragraphs 18.21 - 18.23 of the ALN Code 2021. As to the duties to make the IDP fit with EHE please see paragraph 07.29 of the Nodi guide.
