The duty on the LA to maintain an IDP will cease where:
- The local authority decides that the child or young person no longer has ALN;
- In the case of a young person, the young person no longer consents to the IDP being maintained, or is a child becoming a young person who does not consent;
- The local authority ceases to be responsible for the child or young person because they cease to be in the area of the local authority;
- In the case of a looked after child, where the child ceases to be a looked after child and the local authority is not responsible for the person;
- In the case of a looked after child, the child ceases to be in the area of a local authority in Wales;
- Where the local authority directs the maintained school at which the child or young person is registered to maintain the plan;
- In the case of a young person enrolled at an FEI, the FEI agrees to a request to become responsible for maintaining the IDP or Welsh Ministers have determined that the FEI should maintain the plan,
- In the case of a YP, the YP reaches the age of 25; or
- In the case of a YP who is neither a registered pupil at a maintained school nor enrolled as a student at an FEI, the local authority decides that it is no longer necessary to maintain the IDP to meet the YP’s reasonable needs for education or training.
